The conditions set out below are deemed to have been read and accepted by the customer, whether a travel agency, end user, business or company using the service provided. Otherwise, any provisions that are not accepted must be identified before the journey.
1. Price of the transport service
1.1 The price includes vehicle hire, the driver's services, consumables (fuel, lubricants, antifreeze, etc.), motorway tolls and passenger liability insurance.
1.2 Unless otherwise specified at the time of booking, the User is responsible for:
- the driver's meals and accommodation;
- parking, restricted traffic zone (ZTL) permits, checkpoints, city entry charges, ferries, tunnels, bridges, mountain passes and other similar expenses;
- any changes to the route or schedule that result in costs for Decina bus srl exceeding those anticipated at the time of booking.
1.3 With reference to clause 1.2, Decina bus srl undertakes to notify the User in advance of all expenses of which it is aware. Please note that some charges are set by municipal authorities and are therefore subject to periodic changes that cannot always be foreseen.
2. Service itinerary
2.1 The route is determined according to the option that the company providing the service considers the most economical and safest for both parties.
2.2 The itinerary is agreed between the parties at the quotation stage.
2.3 Any changes during the journey must be communicated to, and authorised by, the company. The change will be recorded directly on the driver's journey sheet.
3. Departure address (pick-up)
3.1 The customer is responsible for ensuring that the specified departure address allows passengers and luggage to be picked up and dropped off easily. If the vehicle cannot reach the requested pick-up location, Decina bus srl reserves the right to replace the departure address requested by the User with a nearby address.
4. List of passengers taking part in the journey
4.1 The User must prepare a list of the names of the passengers taking part in the journey and undertakes to present it or send a copy if requested by the authorities or Decina bus srl.
5. Notification of the driver's mobile telephone number
5.1 The driver's mobile telephone number will be provided to the User on the day before the journey, no earlier than 7:00 p.m.
6. Exclusion of liability of Decina bus srl
6.1 Decina bus srl cannot be held liable for any loss or damage of any kind or nature suffered by the User as a result of any event of force majeure or event beyond its control.
6.2 Similarly, Decina bus srl cannot be held liable, and no refund will be payable by it, if the journey is interrupted or delayed due to force majeure or circumstances beyond its control. In the event of a breakdown, Decina bus srl undertakes to provide a replacement service and bear all associated costs.
6.3 By way of example, events of force majeure or circumstances beyond the control of Decina bus srl include:
- changes to the planned itinerary due to road closures caused by weather conditions, closures of mountain passes or roads due to snow, sporting events, demonstrations, obstructions, dangerous situations or any other issue for which it is not responsible;
- inability to continue due to unforeseeable circumstances, roadblocks, strikes, lockouts, work stoppages, terrorist activities, natural or nuclear disasters, fires or severe weather conditions, unforeseeable transport problems, port or airport closures or congestion, accidents along the service route, unexpected traffic, riots, technical problems or local unrest;
- technical problems or a possible breakdown of the hired vehicle during the journey, except in cases of wilful misconduct or gross negligence by Decina bus srl. If a breakdown or technical problem occurs and/or transport must be interrupted because of a vehicle malfunction, Decina bus srl undertakes to arrange a replacement service to enable the User to reach the final destination and will make every effort to continue the service with as little inconvenience to passengers as possible. The cost of the replacement service will be borne by Decina bus srl.
6.5 The User is responsible for planning the journey to allow sufficient time for connections with other means of transport. Connections with other transport services not operated by Decina bus srl cannot be guaranteed.
Decina bus srl is not responsible for missed connections with transport services provided by other road, sea, air or rail transport companies, whatever the cause of the delay relative to the scheduled arrival time.
7. Subcontracting
7.1 If necessary, Decina bus srl reserves the right to subcontract the requested service to qualified and reliable suppliers in accordance with its Quality Management System.
8. User's obligation to disclose "high-risk journeys"
8.1 The User must inform Decina bus srl in advance of the departure date (at least 14 days beforehand) of any so-called "high-risk journeys". These are journeys involving safety risks along the route, for example football matches, local derbies or demonstrations, and cases in which a police presence may be expected.
8.2 In the case of such a high-risk journey, Decina bus srl reserves the right to cancel the journey booked by the User or withdraw from the contract. If Decina bus srl withdraws or cancels, the customer will be informed within a period of 14 days before departure.
8.3 If a high-risk journey has not been disclosed by the User as required above, Decina bus srl reserves the right to cancel the journey before departure or interrupt it during travel. The User may not claim damages, except in cases of wilful misconduct or gross negligence by Decina bus srl. All requests made by the User will be assessed by Decina bus srl itself.
9. Repair or cleaning costs and damage claims
9.1 The User will be responsible for the cost of repairing any damage or carrying out necessary cleaning of vehicles and property belonging to Decina bus srl where such damage or cleaning exceeds normal "wear and tear" ("Repair or Cleaning").
9.2 If a Supplier reports that Repair or Cleaning is necessary, the User must reimburse the costs of that Repair or Cleaning.
9.3 As a passenger, the User is responsible for leaving the hired vehicle in the condition it was in at departure. The User acknowledges and accepts responsibility for their own acts or omissions and for the acts or omissions of any individual they invite or otherwise allow onto the hired vehicle. If Decina bus srl reports and provides evidence of damage (a "Damage Claim"), the User agrees to repay the cost of replacing the damaged items.
9.4 For lunches or dinners celebrating special occasions or ceremonies, passengers must comply with the following rules: intoxicated persons will not be allowed on board. The group and group leader must be informed of this requirement; anyone who cannot tolerate alcohol should moderate their consumption accordingly. The decision whether to allow a person to board rests exclusively with the driver.
9.5 The User is responsible for proving that they did not cause the damage or that the amount of the damage is lower than the amount charged.
10. Carriage of luggage
10.1 Luggage will be accepted up to the capacity of the luggage compartment. Loading and unloading luggage are the sole responsibility of the User and the passengers. The driver and other coach staff are under no obligation to handle luggage.
10.2 Any unsolicited assistance provided by the driver or other coach staff is a courtesy only; responsibility remains with the customer, except in cases of wilful misconduct or gross negligence. The vehicle's luggage compartment may be opened and closed exclusively by authorised staff (drivers).
10.3 Decina bus srl is not liable for lost, stolen or mistakenly exchanged luggage, including where this results from an accident involving the vehicle. It is not liable for damage or breakage affecting passengers' luggage or its packaging. Decina bus srl also accepts no responsibility for the loss, theft or damage of any valuables, including cash, jewellery, precious metals, keys, sunglasses and/or prescription glasses, electronic devices (laptops, iPads, tablets, MP3 players, mobile phones, cameras), contact lenses, prostheses, medicines, important documents, etc., or any fragile item.
10.4 If luggage or other items are lost, Decina bus srl will make efforts to establish whether they have been found. The passenger is responsible for collecting the items and bearing any costs of having them delivered.
11. Carriage of pets
11.1 Animals of any kind are not permitted. Animals may be admitted on board only following an agreement between the parties and with a muzzle, lead and cage. The owner is fully responsible for any damage caused by the animals to the coach or to persons and must compensate any damage immediately.
12. Coach seating, seat belts, stops in unauthorised locations, infringements and penalties
12.1 Passengers may not board in excess of the maximum number permitted, as stated in the vehicle registration document.
12.2 All passengers must remain seated and wear seat belts until the engine is switched off.
12.3. Each passenger must comply with the requirements of Article 172 of the Italian Highway Code (as amended by Legislative Decree No. 150 of 13 March 2006 implementing Directive 2003/20/EC) concerning the compulsory use of seat belts and child restraint systems in vehicles. Passengers must therefore fasten their seat belts; in the event of non-compliance, the offender is personally liable, and for minors the accompanying adult is responsible. Any penalties or infringements imposed on the transport operator that are attributable to a passenger (for example, unfastened seat belts or requests to stop in unauthorised locations) will be charged to the User together with the costs of handling the matter.
13. Passengers' responsibilities on international journeys
13.1 On international routes, passengers are personally responsible for complying with passport, visa, foreign currency, customs and health regulations. Passengers bear the consequences of any failure to comply with those regulations.
13.2 On international journeys, passengers must carry all documents and identity cards needed to cross borders and show them to the driver and service staff if requested.
13.3 Checked luggage must not be locked, in order to facilitate customs procedures. Passengers must carry only goods that are exempt from customs duties in terms of both type and quantity.
14. Correspondence between the booked vehicle and the vehicle shown at booking
14.1 The Supplier cannot guarantee a particular vehicle model. The vehicles shown on the Platform are for illustrative purposes and, if necessary, may be replaced by similar or higher-category models.
15. Insurance
15.1 The vehicles are duly insured in accordance with current legal requirements, and the liability limit varies according to the vehicle booked. All our vehicles are insured for amounts well above the statutory minimum limits.
16. General rules on drivers' driving and rest periods
16.1 To avoid misunderstandings with the User and passengers, please note that coach drivers must comply with the rules in force on driving and rest periods.
16.2 To meet safety requirements, the transport service must comply with Community Regulation No. 561/2006, which permits driving periods of:
- a maximum of 9 hours of driving per day;
- a maximum of 10 hours of driving per day twice a week;
- a maximum of 56 hours of driving per week (four days of 9 hours and two days of 10 hours);
- a maximum of 90 hours of driving over two weeks.
The driver's daily driving time also includes the time needed to travel from the Supplier's premises/depot to the departure address specified by the User and to return to the Supplier's premises/depot at the end of the journey.
16.3 By law, the driver must take a break after every four and a half hours of driving. The break may be taken in either of the following ways:
- a single uninterrupted break of 45 minutes after four and a half hours of driving;
- two breaks of at least 15 and 30 minutes respectively, without exception, within the four and a half hours of driving.
The second break must be 30 minutes even if the first break lasted more than 15 minutes.
If necessary, the driver may increase the number and duration of driving breaks at their discretion.
16.4 The driver must take 11 consecutive hours of rest within a 24-hour period, with a possible reduction on three days a week, but never to less than 9 consecutive hours.
16.5 After every six days of service, the driver is entitled to a rest period of at least 24 consecutive hours. The regular rest period is 45 consecutive hours. If the driver rests for fewer hours (for example, 24 hours), the difference, with the corresponding additional allowance, must be made up within the following three weeks.
16.6 The driver's maximum daily duty period is 13 hours.
The driver's maximum daily duty period also includes the driving time needed to travel from Decina bus srl's premises/depot to the departure address specified by the User and to return to Decina bus srl's premises/depot at the end of the journey.
16.7 If two drivers take turns driving the vehicle, both must be able to take an uninterrupted daily rest period of 9 hours within each 30-hour period.
16.8 Failure to comply with these rules results in the deduction of two points from the driver's licence and the coach being stopped on the spot. Please therefore be understanding if drivers cannot carry out or extend a visit, possibly requested at the last minute and particularly at night, or make a detour.
17. Pick-up waiting times and extra hours
17.1 For bookings of individual transfers, the coach will wait for customers at the agreed location for a maximum of 20 minutes. After that time, it will be released from any obligation and the service will be considered completed. In this case, no refund will be made to the User. If the User considers a longer wait necessary, they may notify this within one day (24 hours) of the service taking place and, if Decina bus srl can accommodate the request, a sum of EUR 50 will be charged for each extra hour of waiting.
17.2 For hire lasting several hours, the User undertakes to comply with the schedule provided to Decina bus srl. If the schedule is not respected, Decina bus srl will decide at its discretion whether to continue the journey. If it does, a sum of EUR 50 will be charged for each extra hour of service.
18. Passenger conduct
18.1 Passengers are strictly prohibited from:
- shouting, making excessive noise or doing anything that may distract or disturb the driver;
- smoking on board the hired vehicle, including electronic cigarettes;
- consuming meals and/or food and alcoholic drinks on board;
- standing in the aisle during the journey;
- obstructing passageways and boarding areas;
- tampering with vehicle equipment;
- boarding while intoxicated or under the influence of drugs.
Any conduct contrary to the rules set out above will result in the applicable insurance cover not applying.
18.2 Decina bus srl, through its authorised drivers, may refuse to carry anyone who is under the influence of alcohol or drugs or poses a danger to the driver or other passengers.
19. Tips for drivers
19.1 The price paid by the User is intended to compensate Decina bus srl in full for the services or goods provided.
19.2 Tipping the driver is not compulsory. However, if you are satisfied with the service, a voluntary contribution is certainly appreciated.
